That's how I read it. Someone told me they thought HJOE had requested it, but then later recounted that thought. I recently received the filing and to me it looks like KBM did the requesting. Perhaps what HJOE was trying to settle for was not enough and so they want to take their chances with a jury trial. I really hope they lose the whole thing, if my thinking is correct.
