Students of all faiths can use school facilities for prayer, just not during class time.
Who was harmed? That is the question in all legal challenges. And of course the government is neither 'establishing' nor 'prohibiting', which is the heart of the matter.
Your statement about the ACLU is contra-factual. However since liberals more often are concerned about civil rights and civil liberties than are conservatives, their interests more often coincide with the ACLU.
