The issue of lawsuits and the settlement of contingent Lifescan liabilities is still a few months off.

But, I believe KB's strategic plans have now changed. If this offer is the only offer that J&J receives, even if as I believe, J&J is part of this offer to themselves, KB is more apt to want to take advantage of the stand-still agreement this type of transaction demands, and get as many new products on to the market as possible. There will most likely be NO new IP infringement suits to gum up J&J's works.

And it might also mean that KB, seeing a strategic business opportunity, would settle the J&J suit sometime in the early summer.
