I think people here need to recognize that even if what Session's did today is upheld, if the Fed's truly go after recreational marijuana in State's that declared it legal, our products will be sold in those states once they're available here. It's clear to me that Congress has protected cannabis where it's sold as a drug, and it's also clear that by drug they're not saying something approved by the FDA, but rather cannabis in practically any form as long as it's sold in a store that sells it by prescription.
It may turn out that Session's declaration might once and for all get Congress to take some real action, I just saw where a Congressman from Colorado will act to prevent all appointments by Session's until he makes good on what he was told during his hearing to become Attorney General, namely that he wouldn't interfere with cannabis in State's where it's legal.
I'm not suggesting that we'd be better off with Session's maintaining his position, but if first we put our products on sale anywhere in the world and develop anecdotal evidence of their efficacy, those products will be demanded in the U.S. in State's where they can be sold as drugs. It's very possible that State Laws may require them to be manufactured in that State, which certainly would add cost to the products, but I believe they're lucrative enough to find companies who will meet the requirement.
While this is far from ideal, until Congress acts it may be what must happen, but it may also work to force Congress to act.
