I think that the Judge realizes they made a huge mistake and has been trying to see a way out and this was the best of the bad ways to try and stay out of trouble. This will make it easier for Ropes & Gray to go after them in an appeal and since the patents are not invalidated, they can now resume their other cases immediately!
