For Gemalto it would be all about the deal with Thales. If Thales put in a requirment that all pending litigation must be concluded before they complete the purchase. Then it would be in Gemalto's best interest for the purchase to get this done and over with instead of waiting on the results of an appeal that may not come for a year+.
