The Litigation Financing is for a total of $3M. But $3M is to much to take, especially if it wouldnt all be needed (IPR denial would accelerate cases). So it was broken up to the $1.5M (enough to pay operating cost through end of Jan.) initial loan. If the 101 went in SFOR's favor that would be enough of a loan and SFOR wouldn't be on the hook to pay a return on the other $1.5M.
But the $1.5M on the back half is avail. for the duration of the appeal (I read around 6 months) in $250K incriments (once again if the 101 appeal only take 3 months SFOR wont be on the hook for more than they need to be).
All should be aware that the Litigation Financing is tied to settlements as per the 8k. IMO. As far as I can tell if SFOR loses the appeal the money is not payed back.
