No, the judge is at the central district court of CA, another words he is a district court level judge not the appellate level (9th circuit).
It is not removed to the CAFC, in fact, RG hasn't even appealed yet but intends to appeal to the CAFC.
The reason RG can appeal to the CAFC and not the 9th circuit is that this/our case concerns patent law.
