The SEC claimed at the time Reg SHO went into effect they had to grandfather all the previous shorted shares lest they cause the system to fail. The grandfather clause was added in the dark of night without public input or discussion but had plenty of input from the guilty parties. Those SEC Commissioners should have been prosecuted IMHO.
