That is an option but if not legally required or will benefit the appeal, a Judge with BRS would need to acknowledge he is not God and admit to basically being wrong, which to them may compromise other rulings and/or future decisions.

Having said that, it maybe a legal requirement to do so and if not, I would simply appeal and get it out of his hands as quickly as possible.

Far be it that a Judge was convinced to rule against other prior rulings in the case to benefit an old, or new friend!
