Big concession by defendant:
"That
information might prove to be even more relevant to the valuation of StrikeForce’s patent than
the particular terms upon which StrikeForce finally agreed. That information might also shed
light on the veracity of certain representations that StrikeForce made in the settlement
agreement. For all of these reasons, StrikeForce should be ordered to produce the Entrust term
sheet and any drafts, correspondence, or other communications regarding the settlement."
IMHO this means Centrify is saying the patent has value AND also that it is relevant in this case meaning monetary damages are a consideration. It is basically saying yes it has a value and let's negotiate and also yes let's say it does apply here. Just IMHO as I am certainly no attorney.
