Sine PTAB declined to institute an IPR to even one challenged claims by petitioners (Centrify,DUO & Trustwave ), this denial will be relied upon in a concurrent District Court in New Jersey litigation to show that the burden of proving invalidity cannot be met.
Petitioners took the same claim construction & challenged claims from District court @ PTAB/USPTO, so considering all possible scenarios, these petitioners cannot challenge the claims denied by PTAB/USPTO in district court.
From the day of denial, I expect with in 30 days i.e. on or before 11/16/17 rest of the six cases will settle .
