Good point.
They would really piss off the toxics if they took shares that were reserved for them and gave them to CHF and Dominick.
From the last proxy:
"On September 1, 2016, we had 75,356,985 shares of common stock issued and outstanding and 74,643,015 shares of common stock that were authorized but unissued. At September 1, 2016, we had reserved shares for future issuance, consisting of (i) 871,185 and (ii) 73,771,830 shares of common stock potentially issuable upon the conversion of outstanding Series C Convertible Preferred Stock, Series D Convertible Preferred Stock, Series E Convertible Preferred Stock and Series H Convertible Preferred Stock as well as various warrants."
