Sox: Glad to see you are doing additional DD on naked shorting. Banning it and enforcement of the ban are issues. The regulators know exactly what is going on and choose to look the other way or when they have no choice hand out slap on the wrist fines:
"Participants in naked illegal short selling activities can be charged with a crime based on the SEC regulations. In 2014, two Florida State University professors were charged with participating in the illegal practice that resulted in approximately $400,000 in revenue. Ultimately, the accused agreed to a settlement with the SEC in the amount of $670,000.

While no doubt some would believe that naked shorting has been banned in the US, it is running rampant with billions being stolen from investors.
