Without reading J&J's pleading I am sure it will be replete with negative comments about DECN's expert, DECN itself, DECN's management and their gold-digging plans. They will lie, they will ask the judge not to believe his lying eyes. They will direct their Motion to things not a part of DECN's claims. The pleading will be very short on facts. And none of this will be lost on the judge. The whole process is for J&J lawyers to buy time with J&J senior management.

This part of the case will now be on a 21 day cycle. DECN answers by August 14, J&J gets its last shot by September 6 -- the rebuttal of the rebuttal. Then a 6 week documentation discovery will begin and run to about October 13. Three weeks for briefing and the Summary Judgment hearing first week in November.
