Hotstockerz- When price opens above the previous days close and continues to trade above that point for the day, then it is a gap. Here is a useful link on gaps:

Some people like to use the entire price range of the 1st day, not just the close, so in that case they would not recognize your example as a gap,because they are including the 1st days high. (but technically you example is a gap up from the prior days close.)
