Absolutely true.

J&J is using their one time only stall and even at that they are sending a signal to the judge that the case is not as easy as they thought. If you had a summary judgment ready to go and only needed the testimony from the expert to salt away the Summary Judgment, why would you need more time? What thoughts does the J&J expert need to put together if the case is as clear as the nose on your face. Message board posters who hate the company think J&J has it in the bag. They thought the same in the first case.

J&J is in trouble. Dr. Smith is about to become road kill and with it J&J's clear cut case. And once the Summary Judgment Motion is denied, and it will be, because almost all are denied, J&J will be forced to sue for peace because they will have already put their entire case on in that Summary Judgment. I believe this is called a Hobson's Choice.
