Why do you think KAY went with HSN now when it was confirmed almost 8 months back? Ropes & Gray/BR advised Kay now because BR and Kay knew defendants will take it to IPR before they filed the lawsuits. Peeps need to do some homework how these exposure/sales helps the plaintiff in any form of lawsuits especially telling the court/IPR/USPTO about lost revenues over several years because of these infringers.
