Patents are temporary and trademarks are, or can be anyhow, forever, as long as you file the necessary documentation and pay the associated fees.
You should read this article. It explains very nicely why most big players in the food and beverage businesses (among others) PREFER to forego patents in lieu of trademarks to protect proprietary trade secrets which they are not required to divulge as they would be to acquire a patent.
