They are forced to create the shares for real and then cover them I believe. Just went thru this with another stock.
That's part of the risk of naked shorting. I am still learning about all of the ramifications of naked shorting.
No, it's not legal, but the SEC turns a blind eye because the MM are suppose to "police" the markets for scams and such as well as maintain some kind of liquidity of stocks on the OTC. Thats the way I understand it anyway..
