That is not insider trading. It's heresay. Supposedly, his brother is a doctor and supposedly his brother is hearing that the cream is working well. That could be from patients in the clinical trial showing off clear skin in the cafeteria, it could be comments from nurses making rounds who notice an improvement, etc. etc.
Insider trading is someone at OWCP telling him results before announced. That is not what he says is happening.
If I'm dumb enough to yap about stocks in an Uber ride, it isn't against any securities laws for the Uber driver to make trades based on my conversation.
