Having the motion granted in HJOE's favor would be momentous but it is still probably a long shot. With numerous delays from Plantiff and several attorney changes - no judge is going to be real happy with the courtroom congestion or legal theatrics. However, summary ruling is supposed to be a used sparingly per Supreme Court ruling. We dont know what type of "defense" KBM will mount in response and so far-nothing has been filed. Preliminary filings have shown their case resides strictly on contract law and the language inside the law despite any questions concerning legal rate of interest, conflict of interests, or good faith proceedings before/after contract was signed. Unfortunately- I have seen first hand the confounding nature of our courtrooms when it comes to contract law and partnerships so I am not expecting anything 1/4 that is positive/game changing.
