Agree with the desire here that a counter suit should be made - BUT - I have to accept that CTIX (one of many companies that have been wronged) is a BIO company not a legal firm. They have , and many would agree, retained a great law firm to represent them. Due to successful proceedings so far CTIX (Leo) has reason to have faith in any advice Sullivan/Ashcroft may give them and so would I. So if there is to be any counter suit it would be on the advisement of Sullivan/Ashcroft who know the law and the odds of success. Leo's first obligation would be to the company CTIX and shareholders. He cannot be obliged to be a crusader , that's not to be his calling as a responsible company manager. So in a nutshell to me its ALL mainly in the hands of Sullivan/Ashcroftan as to how to proceed with of course an agreement with CTIX as to how the costs are covered should the path be a counter suit.
