They originally did 30 days on the exclusivity period, then extended it for 30 more. Then they extended 60 days after that. I'm pretty sure if they were just negotiating, they would have done just another 30 days. If you were negotiating with someone, you wouldn't well into the process suddenly say you need that much more time- you would do it slowly, a little bit at a time, then ask for more as you needed it. I'm pretty sure they are waiting on something- as far as what who knows, I could think of 10 different scenarios. It could be a contingency to the deal or it could be AMBS just delaying to get their finances in order.
As far as the nonpayment to Lonza, I don't think it really means much- we all know AMBS is broke and they will need money to start the trial- this is just one more unpaid bill to throw in the pile. It's not as if they were going to start the trial tomorrow anyway. I'm still expecting the partner to come up with some cash and even if it is not a lot, it should still be enough to pay Lonza and start the trial- (and pay for at least half of the costs) The bigger question is what will Magna agree to to make all of this work.
The biggest question I have is what is the status of the AFIRM grant? Some people have said AMBS couldn't qualify in their current situation, maybe the partner can?
