The SEC is there to protect shareholders. If $HJOE definitively proves that they ARE doing just that by NOT filing - then there would/should be no reason to penalize them as it would be counter to their purpose.
If they show they are keeping shareholders informed through SM, show examples of other companies that kept doing R/s (like $TBEV ) and eviscerated shareholders, show attempts to reconcile debt with KBM that WAS in the best shareholder interest, etc - it would make no sense to shut the trading down.
That being said - it is a governement entity...
