Actually what I meant was at least the judge isn't dismissing the motion for summary judgment. Which could mean the magistrate may have decided the motion has enough merit to warrant further investigation before making a report/ ruling on it. Then again it could just be a lawyer change or stalling tactic on KBM's behalf.
