I'm guessing they have a deal worked out with the partner, but there is a contingency they are waiting on.
They wouldn't have entered the 30 day exclusivity period unless they were comfortable they could make a deal. Anyone who knows negotiation 101, knows most negotiation happens at the end of a deadline- it doesn't appear they extended the 30 day period again, so they probably signed an LOI and are waiting for something else to occur before they can close the deal. My guess it is either related to the FDA or the Army.
One of the things I have wondered about is the ODD and the RPDD they applied for back in Dec. They should have at least received a response on the ODD by now- obviously those are both things which would impact the value of ESS.
