They don't want it. They've made it fairly clear that they are interested in taking this to jury trial. We know it's risky and anything can happen there, but they are coming off as very confident in their chances.

On the other hand, I'm a sure they will gladly accept a summary judgement ruling and a null and void contract with no necessity to take it further. Time and money saved.
