That's what I took it as well. By no means does this mean that HJOE has been successful with summary judgement. It is standard fair for these things to be moved for decision. I do think it becomes a "sweat it out" period for both sides as a judge can look at it and rule one way or the other.
If we look carefully at KBM's prior cases, many have been voluntarily dismissed by KBM through settlement or dropping the case. Beyond doubt, they are lawsuit happy with well over ten cases on prior dockets and this may not go over well at the next level. Judges certainly do not like their dockets clogged.
The pressure is definitely ramping up and a decision could come down at any point. With all of the exhibits that HJOE has submitted, it tells me they have "something." I don't know what that something may be, but there is more to this than meets the eye.
September 13th update will ramp up the pressure even more as this move closer to trial and counter suit and trial.
