Just realized why "they" are trying to focus the discussion on hypotheticals.
By getting people to spend time and energy on absurd scenarios, they are taking people's attention away from the devastating proof that Mr. Sullivan provides about the magnitude of Rosen's misdeeds.
Re-read that document, and his letter to the Rosen Firm in October 2015, and you will be struck by several things:
1) Sullivan has an excellent team of researchers finding precedents
2) He writes extremely well
3) His evidence shows that the request for sanctions against the Rosen Firm is supported by Federal law as well as rules for professional responsibility
4) Rosen Firm came with a set of brass knuckles to a gunfight.
