Actually my understanding is even if the appeals court over turns the ruling the sanctions and penalties can still apply. I belive the point Sullivan is making is that Rosen cane at them with empty office and a scam where no drugs worked. All those things are easily proven that Rosen failed to do thier due diligence. The law clearly states that throwing things on the wall until something sticks is illegal and sactionable. From my understanding. But I belive Sullivan also referenced that if Rosen continues with this appeal and loses the punishment can and will be harder.
