If you base the legal terms on how they judge Martha Stewart, then yes it is illegal. However if you apply the Hillary Clinton Standards, He could do far more and still not be doing anything wrong.

Its a really grey area, but I would recommend that he should not be sharing too much information as he may run the risk of something illegal. I believe that is why we don't get dates or hard information. We are only getting generalities. If he is giving someone enough information to nail down specifics this could be a bad thing heading toward illegal.
