If a lawsuit is going to be filed against Zagami and Rosen, I would not expect it to be filed until the current appeal by Rosen is exhausted. I say that because any such lawsuit would most likely be based in whole or in part on a claim of malicious prosecution. A cause of action based on malicious prosecution is only appropriate after a final determination is made in the original case. That would be true whether the case is brought by CTIX or as a class action by the shareholders.
