That is a good answer and i'll continuing to play devils advocate because as we all know court is a crap shoot. KBMs response to that will be, "but we didn't charge them interest, we converted shares to ours and their profit."

I can definitely see HJOE having a change of heart, especially Veal, in that the conversions began to crush the PPS. It also hurt SH value, and perhaps they decided we were worth a bit more to them as supporters of their company then allowing KBM to further devalue their stock.

Either way this case has definitely heated up and the HJOE motion was a good one.
