I've seen that before, but what it doesn't speak to is timeliness of moving parties response. Last update on PACER was 7/10/16. If updated tonight at the same time with no response, perhaps we can just assume the court hasn't updated the full brief yet. However, HJOEs was updated immediately with all of those material facts that no issue exists. I'm probably just reaching for straws.
