Maybe they would accept it. I have no idea. Did HJOE offer that? KBM probably wouldn't accept it because that's not in the contract just like HJOE wouldn't accept an offer of a 100K payment to KBM because that's not in the contract either. But I don't see anything on Pacer that mentions either party making any settlement offers
