Can anybody on this thread discuss with accuracy and evidence that a "death spiral" occurred on HJOE when in fact the SP rose through the beginning of a stop sign and sunk on the continuation of the stop sign with indication that HJOE would not file anytime soon? That's basically classic market psychology running it up and flipper and long shareholders cashing out when the expectation was not met.
I would think logically that a death spiral would occur when the stock retraced back to its origins and sat at the low triple levels or no bid or volume activity. Examples ... AJAC, GTGP, ANAS.
I'm going to argue that KBM has barely scratched the surface of death spiraling HJOE and grounding them down into the low trips. We already know the complaint is seeking 64.5K in damages "exclusive" of late fees and interest, which we all know will be demanded, otherwise the complaint would have read "inclusive" of all late fees and interest.
The fact is, if HJOE files this moment and triggers conversions while KBM drains 25% of the daily volume monthly on however many shares, hidden shares, shorted shares or whatever they have, the HJOE share price will crash through the floor and we will get annihilated. I'm not too certain Locke will get annihilated as my sense is he isn't a shareholder, but we can still look at his position and rebut it with some decent amount of accuracy.
