I think it all depends on the information that HJOE has that hasn't been made public. What was said during telephone call during last motion, we simply don't know all. Unless someone has inside info, I honestly think summary may be granted. I think Goodspeeds outcome will happen if KBM feels they can actually say something that can offset the facts that IMO HJOE has already put forward. Again I'll say this, a judge will not clog up their schedule for a "he said she said". If HJOE's motion is legit and The tone of KBM's motion stays the same what would a judge use to justify no summary judgment.
