OPPS, I messed up. Alcohol is not on the scheduled list of controlled drugs. It is legal because of the 21st amendment and controlled by the ATF.
So, I think the ruling should be that it should follow the alcohol route and with similar guidelines. Which , in essence would remove it completely from the Controlled substance list. By using preemption the Federal government could control any derivatives of the plant to produce specific medications or enhanced products.
