Thesmalls, that point is excellent and a judge should see how many obstacles and hurdles the company has had to overcome. They should be allowed to file,without penalties. (even for company employees to get paid)
If filing got the pps to .03, 3-5 million shares would easily cover loses. it would also be absorbed quickly, in a day or so,
(based on a very bad outcome) Yet, it would minimize dilution too, in a major way.
Not allowing that hurts investors and the company as much, if not more than the exorbitant interest rates,endless shorting, and massive dilution. Toxic lenders would be manipulating the system on both ends... Any smart judge should see that..
