Hit my post limit for the day apparently. Funny, I didn't know I had a limit. Oh well.

It is my understanding that today's ruling is With Prejudice, meaning Rosen can not abridge the claim and refile. They would need a new complaint, plaintiff, etc, altogether. Not going to happen.
