Judge mentioned another case where a judge was chastised by a higher court., back at oral arguments many months ago. She obviously does not want to be overturned. There is no way she will do anything but write a decision that is in accordance with the law and mainstream interpretation thereof.
I think DD2 was right that the longer this takes, the better it is for us. If she were just going to pass this on for trial, would it take this long to write the decision? But if she's throwing it out, she needs to have every possible claim covered that Rosen could possibly use as grounds for appeal.
thefamilyman, I share your cynicism about the legal process, having seen several examples of influence on judges being used to the detriment of justice. But in this case, I remain optimistic.
