That Supreme Court ruling which was unanimous has increased the costs of naked shorting substantially. RICO which generates treble damages should be easy to prove. Once the cases start rolling in I expect the brokerage firms to start demanding good delivery which they have neglected to do for years enabling criminal behavior. This should all but eliminate abusive naked shorting imho.
