My condolences, GB. That's absolutely tragic. My family has been on the other end of that type of tragedy, losing my cousin, who was killed when a young woman ran through a red light and T-boned him. She was fine, but my cousin died, leaving behind a wife and two teenage children--a girl and a boy.
An important difference between your brother and Foley is that your brother likely wasn't charged with a federal crime, Foley was. Due to the Sentencing Reform Act of 1984, there is no parole for federal crimes convicted after November 1, 1987. You can get an early release with a good time credit, but that only entitles you to a 15% reduction of your sentence. I believe Foley was sentenced to 22 months in federal prison in early June of 2015, which means he can be released as early as the middle of December, this year.
