All employees of companies that make gaming machines (slot machines, etc.) have to be approved by the Nevada state gaming control board. The purpose is to weed out employees who might rig a game at the manufacturing stage and then walk into a casino and take advantage. D. Foley would have to get a license from the board.
The process is extremely rigorous even with a perfect record, and if I recall correctly having a felony conviction results in an automatic denial. If ntgl made him the CEO there is not a casino in the US, probably the world that would buy ntgl products.
Thinking about it, that is probably the reason they spun ntgl off into it's own business, so foley could come back to ntek without interfering with the sales of their gaming products.
