They only have one case right now unless there are other skeletons we don't know about. Regardless, it does look like HJOE wants to go for the jugular, but I'll also say this, while in litigation they cannot focus on the other half of their business which is their financial health and responsibility to the publicly traded securities.

If a judge pushes and hears argument, she (I believe the judge is female) can determine how this will play out and "warn" the parties of law. In this case, if discovery shows usary and fraud, the pissing contest may end quickly, especially if the judge states what could happen at trial.

Also, a trial could last another 8-10 months or perhaps even a year or longer, could it not? Again, I do think HJOE is pushing for trial as well to bury KBM, and they do need to be buried, but a quick settlement without convertibles, may be the best way to get these people out of the way and get back to the entire business model.
