Thank you for taking the time to contact my office about the nomination of Judge Merrick Garland to the Supreme Court. Your input is important to me, and I appreciate the time you took to share your thoughts.
An ardent defender of the Constitution and the principles set in place by its framers, Justice Scalia was a remarkable jurist who always sought the original meaning of our nation's guiding document. He leaves behind an extraordinary legacy and a life of service to our country that is admired by many.
As you know, the President has the right to nominate a Supreme Court Justice, and the Constitution gives the Senate the power to decide whether to confirm the nominee. At this point I believe it would be more prudent to have the American people express their voice in deciding the future direction of our country. Both sides of the aisle, when a president of the other party has been in office, have stated that filling a vacancy that occurs on the Supreme Court during the president's last year is not the right thing to do. Accordingly, the Republican members of the Senate Judiciary Committee have come to the consensus that the Senate will not consider a nomination until after the American people have a chance to vote in the Presidential Election.
You may also be interested to know that I have consistently opposed Supreme Court nominees whose record demonstrates a misunderstanding of the Constitution and the role of a judge, including the nominations of Sonya Sotomayor and Elena Kagan.
