IMO the judge doesn't want appeals, being overturned, etc. and is going to make absolutely sure that every possible ground for appeal is squelched.
Also, think about this: the longer she waits, the more probable it is that there will be news that makes the Rosen claims obviously untrue, and thus more easy to dismiss the case with no fear of appeals. Do you think that she doesn't read the CTIX website and press releases, as part of her fact-finding process? I can't imagine that she doesn't read every single document CTIX publishes.
She may be biding her time to await further news.
