LOL, not.  If you fail to serve the defendant in the United States then your case is dead and, if anything, could get thrown out.  It wouldn't be the first time a law firm threw in the towel.  Remember the lead plantiff in the class action threw in the towel and the entire firm withdrew, according to the law firm as it informed anybody who called to inquire.
