There's a hyuuuuuge difference between the clearly evident intelligence of Sullivan's response, and the various poorly-written, flailing and illogical responses by various members of the Rosen firm.

If I were a judge, at this point I'd be more concerned about repercussions from letting this idiotic, obviously baseless case proceed than I would be about an appeal by the Rosen firm. I don't for a minute believe that any appellate court would find in Rosen's favor after viewing the nonsense they have spewed, ESPECIALLY given the constantly changing nature of the absurd allegations. But a judge who wasted precious trial time with this nonsense might be viewed unfavorably by the legal profession... especially judges from the higher courts (and those who NOMINATE people to be on those higher courts).

The Rosen lawyers are chihuahuas yapping at the heels of their victims, and the little sons of dogs are unused to facing any resistance. Most companies think it's cheaper to pay them off rather than spend time and money fighting them. Kudos to CTIX and Leo Ehrlich for pursuing these expletive-deleteds.
